MINUTES OF TSEWA EXECUTIVE COMMITTEE MEETING HELD ON 16 MAY 2018 AT 0900 HRS AT 143, VAYUPURI, SECUNDERABAD

President welcomed all and thanked them for coming for the meeting.
Points from General Secretary
Progress of AFT cases: It has been decided that in future, we will file all of our AFT cases only at AFT Delhi and AFT Lucknow, since only these two AFTs are accepting litigants from all over India with the Lead litigant from Delhi or Lucknow. All other AFTs are restricting the Litigants only from their area of jurisdiction.
Sqn Ldr Amitava wanted to file some cases at AFT Mumbai. It was already decided that we cannot file any case in AFT Mumbai for Litigants from all over India. It was decided that Gp Capt Sastry will send a suitable mail to Sqn Ldr Amitava, explaining our present position.
Brig SKS Rana VSM had confirmed that Lt Col RK Tripathi will be given only AFT 20 and AFT 21. Other cases will be handled by Brig AK Srivastava VSM. Some additional documents are being asked by Lt Col Tripathi, after we have collected all the 4 required documents from the Litigants. All present, felt that going again to all Litigants for additional documents will entail lot of delay and work. So Gp Capt Sastry was asked to talk to Brig SKS Rana VSM, that he should get in touch with Lt Col Tripathi and sort out this problem. So far Lt Col Tripathi has not given even the format for the Affidavit for the Lead Petitioner in spite of one month delay.
It was decided that AFT 29 B is not closed. If any one sends the documents and the Legal Fees, the same will be accepted. Gp Capt CRR Sastry was asked to talk to Brig SKS Rana VSM, and decide whether AFT 29 will be filed at AFT Delhi or AFT Lucknow.

Leave rules for our staff: General Secretary informed that we do not have any policy about leave for our staff. After some discussion, it was decided that (a) all holidays declared by Telengana State Govt will be holidays for our staff (b) in a calendar year, they are allowed to take only 15 days paid leave. If they take more than that, their pay will be cut (c) when ever possible they should apply for leave in advance and get it sanctioned. In any Emergency they should ring up and inform General Secretary/ Treasurer about their in ability to attend the office before hand and (d) they should strictly follow the working hours, i.e from 0900 hrs to 1300 hrs and in the after noon from 1400 hrs to 1700 hrs. General Secretary will issue suitable instructions on this.

Periodical updating of Progress of AFT Cases: General Secretary informed that members keep ringing him up and ask for the progress of the AFT cases very frequently since the updating is not being done on a regular periodicity. It was decided that Brig SKS Rana VSM, will be asked to give the progress once in a month, say during first week of the month. This will be updated in our Blog by Mrs Rekha Sekhri, Administrator of TSEWA Blog.

Time frame for filing the AFT Cases: As discussed during the last meeting, the time taken from the time the documents are sent to Delhi, till the cases are filed in the AFT, seems to be more. Many of the members are not happy with this delay. So it was decided that Brig SKS Rana VSM, will be asked to give a rough indication about the time required by him and Brig AK Srivastava VSM, to check and file the cases in the AFT.

Renewal of ISO 9001:2015: General Secretary informed that the internal audit for renewal of ISO 9001:2015 is in progress by the GIC, London. Very soon this will be completed.

Points from Treasurer
PIL Case for 64 KB ECHS Card: Treasurer informed that out of the contributions received for filing PIL in Hon’ble Supreme Court on 64 KB ECHS smart card, a sum of Rs 3,30,000/- have been identified for the Litigants. Another Rs 26,000/- is not identified due to non-availability of details of the members. In spite of repeatedly informing the officers that when they send the money through NEFT, they must give their names, membership number, or send a photocopy of the transaction slip. Still some members have not sent the details. The names of all those officers whose details are available will be put up in our TSEWA Blog, with the request that those officers who have paid the money, but their names not appearing in that list, should inform their details of the date of sending, their names, membership number etc. Only then their names can be included.
Refund of legal fees paid by Maj Gens & Equivalents: Treasurer informed soon he will start refunding legal fees of AFT-1B and AFT-1C to the affected officers.
Points from Col Veeramani
Col Veeramani informed that so far no out station NEC member has intimated their arrival/ departure plan. He wanted a clarification, whether accommodation for State Presidents if they come for AGM is to be made by him. If so a detailed mail to go from General Secretary, informing the State Presidents to attend the AGM on 24 Jun 2018, if possible. This was agreed. It was also decided that the decisions taken on 23 Jun 2018, at the NEC meeting, will be included by the General Secretary in his Annual Report.

Brochure of TSEWA: Cmde Sudheer Parakala suggested that in our Brochure and also in our first News Letter, the gist of the SOP on Charity ( i.e the check list ) should be included. This was agreed, and Gp Capt CRR Sastry was asked to do the needful.

Points from Lt Col Ravi Choudhary
Position of MSP case: Lt Col Ravi Chowdhary informed that he has written a letter to MOD regarding MSP to be made applicable wef from 01 Jan 2006 and not from Sep 2008. He has got a reply from MOD, where in they have referred to a Judgment by the Supreme Court, where they have turned down an appeal for the MSP to be made applicable from 01 Jan 2006. President brought out that Supreme Court had agreed for the ACP ( which is deemed to be part of pay ), has been made applicable from 01 Jan 2006. For all purposes MSP is also a part of pay, and hence should be made applicable wef 01 Jan 2006, and not from Sep 2008. He was asked to take up the case with MOD with the details.

Progress of Family Pension for Mrs Padma, W/O Declared Deserter Ex Sep of 17 Kumaon: Lt Col Ravi Chowdhary informed that he has already sent a legal notice, to 17 Kumaon and PCDA(Pensions) Allahabad about this case for grant of Ordinary family pension to the wife of missing solider of 17 Kumaon. Their reply is awaited. He was asked to remind them. Also he was asked to contact some Kumaon Regt officer and expedite through them. It was confirmed by H/ Capt Joseph that the Police have given the “Not Traceable Certificate”, in this case.

Points from Gp Capt CRR Sastry
Position of PIL case: The President suggested that henceforth it is better only Gp Capt CRR Sastry should deal with Brig SKS Rana, VSM on all legal cases. If most of the members of Executive Committee (Hyderabad) start speaking on legal cases with Brig SKS Rana, VSM, then confusion will result. This was agreed to by all.
Gp Capt CRR Sastry said that he has spoken to Brig SKS Rana VSM, who had asked for five documents. He has written to the concerned people under RTI Act 2005. He has to wait for 45 to 60 days before he takes up the case. In the meantime he will discuss with Brig SKS Rana VSM about sending a Legal Notice in this regard to Min of Def.
