Broad-Banding of Disability Arrears from January 1996 or Date of Retirement
Important Information for Eligible Disabled Veterans and Dependants
Documents Required for Filing Case before the AFT (PB), New Delhi
TSEWA is proposing to file a new case before the Armed Forces Tribunal, Principal Bench (AFT (PB)), New Delhi, seeking broad-banding arrears from January 1996 or the date of retirement, whichever is later, in accordance with the judgment of the Hon’ble Supreme Court dated 12 February 2026.
For disabled soldiers who took premature retirement, the claim will be for arrears from 01 January 2006 or the date of retirement, whichever is later.
The following information is important for all eligible persons who wish to join the new legal case.
1. Background – Earlier TSEWA Broad-Banding Cases
Many disabled soldiers of different ranks from all three Services joined five legal cases filed by TSEWA before the AFT (PB), New Delhi, beginning in 2016. These cases were: BB-1, BB-2, BB-3, PMR-1, PMR-2, Two additional cases, BB-4 and BB-5, are awaiting filing.
TSEWA succeeded in all five of the above cases. However, the petitioners were granted broad-banding arrears only for three years preceding the date of filing of the respective cases before AFT (PB), New Delhi.
2. Two Cases before the Hon’ble Supreme Court
Based on the advice of TSEWA’s advocate, 46 out of 103 petitioners in BB-1 and all 153 petitioners in BB-2 agreed to join the legal proceedings before the Hon’ble Supreme Court to seek broad-banding arrears from their date of retirement, rather than having the claim restricted to three years.
TSEWA succeeded in both matters before the Hon’ble Supreme Court on 12 February 2026.
The judgment was delivered in C.A. Nos. 6820–6824 of 2018, Union of India through its Secretary & Ors. v. Sgt. Girish Kumar & Ors.
Following the judgment, three Air Veterans, after receiving Government sanction from Air Headquarters, have received Corr PPOs through SPARSH showing broad-banding arrears from their date of retirement, together with interest at 6% from 12 February 2026, in pursuance of the judgment of the Hon’ble Supreme Court.
3. New TSEWA Legal Case before AFT (PB), New Delhi
Our advocate has advised that those eligible petitioners who did not approach the Hon’ble Supreme Court can now join a new legal case to be filed by TSEWA before AFT (PB), New Delhi.
The proposed case will seek broad-banding arrears:
- From January 1996 or the date of retirement, whichever is later; and
- In the case of disabled soldiers who took premature retirement, from 01 January 2006 or the date of retirement, whichever is later.
4. Who Can Join the New Legal Case?
A. Petitioners who received arrears for only three years
Any disabled soldier who joined an earlier TSEWA case and received broad-banding arrears for only three years may be eligible to join the new case.
B. Disabled soldiers who never received broad-banding arrears
Any disabled soldier who was eligible for broad-banding but has never received broad-banding arrears may also be eligible.
C. Dependants of deceased disabled soldiers
The dependant of a deceased disabled soldier who was otherwise eligible but never received broad-banding arrears may also be eligible, subject to the applicable legal requirements.
5. Who Should NOT Join the New Case?
The following persons should not join the new case:
- Petitioners of PMR-1 and PMR-2 who have already received broad-banding arrears from 01 January 2006.
- Any person in the list of 262 identified petitioners who took premature retirement and has already received broad-banding arrears from 01 January 2006.

- Terms and Conditions for Legal Case Participation

7. Instructions for Preparing the Documents
A. Printing
- Print all documents on A4-size white paper only.
- Print on one side of the paper only.
- Stamp paper is not required.
B. Signatures – Five Signatures in Blue Ink
The following five signatures are required:
- Affidavit: Two signatures as “Deponent”
- Vakalatnama: One signature as “Signature of the Party”
- Authority Letter: One signature as “Signature with Name”
- Terms and Conditions: One signature under “Signature of Applicant (Agreement)”
C. Portions to Be Left Blank
Please leave the following portions blank. They will be completed by HQ TSEWA:
- Affidavit & Vakalatnama: “IN THE MATTER OF: __________”
- Authority Letter: “Applicant No. _____ in OA No. ______________________ hereby authorize, ___________________”
D. Notarisation
- Only the Affidavit page is required to be notarised.
- It should be notarised by a local Public Notary on the same A4 printout.
- The Notary should affix the seal, signature and official rubber stamp.
E. PPO
Attach a self-attested copy of your PPO.

F. Particulars of Client Form
Please complete the Particulars of Client Form in full.
8. Legal Fee
The legal fee for this case is:
Officers: Rs.10,000/-, JCO’s: Rs.5000/-, OR’s: Rs.3000/-
9. TSEWA Membership – Non-Members Only
Persons who are not already TSEWA members are required to complete the TSEWA Membership Form and pay the applicable membership fee in addition to the legal fee.
