ANNOUNCEMENT: TSEWA AFT CASES_SECOND BATCH FOR MAJORS & EQUIVALENTS

Dear Members,

Announcement is hereby made for information/dissemination to the environment, of the COMMENCEMENT of REGISTRATION of the SECOND BATCH of TSEWA Legal cases as per details in the table below.

Officers who may be interested in joining these cases need to read the description criteria of each case numbered serially 1,2 and 3 in the table below. {The AFT case numbers have been given a suffix ‘A’ to indentify that these cases are the second batch of the earlier cases already filed}.

The process and documents required to be submitted for joining/registration for an AFT case are described in the TSEWA blog at www.tsewa.org under the option ‘Join AFT Cases’. For specific queries related to the cases described below, interested officers may call/WhatsApp or email me as All India Coordinator.

IMPORTANT ASPECTS & PRE-CONDITIONS

The following additional points must be taken note of,, which are, conditional to and necessary for, a clear understanding as to the final filing of the cases.

  1. In order to enable TSEWA to negotiate an optimum  Legal Fee with the Advocate, the minimum number of applicants in each case would need to be 50, before the case is submitted by TSEWA to the advocate for further filing.
  2. The legal fee per officer is being maintained at Rs 5000/- per head, as was the fee for the first batches, already filed, subject to the aspects below:-
    1. The Legal Fee per applicant may be increased, based on the outcome of negotiations with the Advocate at a future point in time.
    2. Registrants would be required to remit such increased fee or balance, for acceptance of their case for filing.
    3. By registering for a case, the officer would be deemed to agree to this condition of an increase in legal fee, so that all other co-applicants who register for a case, are assured that the number of applicants do not reduce due to withdrawal, and hence delay the mustering of required number of applicants for a case.
    4. Delays in filing caused by non-payment of fee would not be allowed beyond a period of 30 days. After 30 days from the date of communication of such increase in fee, the applicant officer would be de-registered.
  3. In case the number of applicants for a particular case, remains below 50, even after a reasonable period of time elapses,(our experience has been that it takes 6 months to muster 50 ~60 applicants), the decision to file the case with lesser number of applicants with increased legal fee or, to cancel the filing and refund the fee paid by those officers who had registered, will be taken by the TSEWA Management Committee after necessary consultations with all stakeholders at a point in time, as may become necessary.
  4. All officers interested in Registering for any of the cases below should send their documents, first as scanned copies by email to me. Hard copies that need to be submitted to court should be sent to me by post at my address below, ONLY after receiving a confirmation that scanned copies  are okay. This is to save time, effort and money on post/courier of individuals.
  5. Further, please note, that a datbase needs to be maintained of all registered applicants on a specified format. This format will be shared over email, with those individuals who wish to register for a case, in reply to their first email submission to me.
