The President welcomed all present and expressed his happiness on good attendance in the meeting. He laid the stress TSEWA could be what it is today because of invaluable contribution made by members of the Core Committee. We may differ with views but have to ensure the growth of TSEWA continues to attain much greater heights. He requested all members of Core Committee to postpone or readjust their commitments on Wednesday to be present in the Core Committee meeting. He requested the General Secretary to speak on his points.
Points from the General Secretary
Hony Nb Sub Case (HNS) Case: General Secretary gave out names of ten applicants who are very abusive in their interaction with TSEWA Volunteer Office Bearers because our advocate was not able to get OA No from AFT, Delhi. They were removed from the legal case and their legal fees in full was refunded. We received their acknowledgement of their legal fees.

Removal of Maj Gens from Cases filed/ to be filed: The matter was discussed and it was found that there are similarities in AFT Case 1 with that of Maj Gen SPS Vains case in which benefit was given to all similarly placed officers. Hence the names of Maj Gens can be removed. However, there is no congruence of subject matter of AFT 29 with that of Maj Gen Vains case. Hence there is no need to remove their names from this case.

Cases to be Filed in Secunderabad: Consequent to decision in the last meeting, the cases that are under scrutiny at TSEWA Hq were reviewed. As there are too many cases in AFT Delhi either filed or awaiting filing, it was decided to activate all regional benches of AFT. The petitioners are justified in asking as to why cases are not yet filed in AFT. They are satisfied once the case is filed and OA No is received. They do understand that adjudication of cases by AFTs, receipt of judgment and follow up action takes time. It was decided that all cases held in HQ TSEWA henceforth will be filed in regional benches for which we need to identify suitable advocates. AFT 28 B (Improper Fixing of Basic Pay of Majors in 5th CPC) and AFT 17 (Reservist Case) will be filed. Legal Notice is already issued in AFT 28B by our advocate in AFT Chennai and the case will be filed by second week of December 2018. Legal Notice will be issued in AFT 17 by second week of December 2018. Memo of Parties was handed over to Lt Col Ravi Chowdary, our advocate in AFT Chennai.

Donation: General Secretary spoke about an offer of Rs one lakh donation from Ms Nirupama Sibal on behalf of her Group based in Dubai, UAE. The meeting approved acceptance of the donation.

Broad Banding (BB)Case: General Secretary informed that our prayer for arrears in these cases should be from the date of retirement. Our Counsel in AFT Delhi said that he has already made the prayer to this effect.

Contribution for Capt VS Gurung: Some offers for contributions were received, but they were told that the contributions should be directly to the account of the Ex Officer being maintained by UESL, Dehradun. They should contact Brig Rajendra Singh Rawat.

Articles in Fauji Magazine: He said that article on “Increase of Service for Pension for Army Jawans” written by Gp Capt CRR Sastry Jt Secretary was published in the Nov 2018 issue of the Magazine. Jt Secretary added that two more articles “Utilising Armed Forces Hospitals for Treatment of Beneficiaries Government Health Schemes for Civilians” and “Unity of ESM Organisations” were accepted for publication in December 2018 and January 2019 issues respectively. Cmde Sudheer Parakala suggested that we may have to revise and update the article on “Unity of ESM Organisations” in view of the forthcoming meeting with Hon’ble Raksha Mantri as and when it is held. Joint Secretary said that we may write a separate “News Item” on the meeting which can be carried in the same issue.

Exemption under S 80G of Income Tax Act: He said that Application was sent by our Chartered Accountant on-line as per the revised procedure put into place by Income tax department. It is under consideration by the concerned authorities. Appointment for interaction with IT Authorities is awaited.

Prayer Meeting in Memory of Col MK Veeramani: The Prayer Meeting is scheduled to be held on 18 November 18 at his residence at 6pm.

Formation of Confederation Units AP & TS: He said that Col N Sitaramaiah has made substantial progress in identifying some large ESM Organisations at Anantapur and Tirupati and hoped that they will join NCESMO by electing one of them as President of AP Unit of NCESMO. He said that the work of identifying such organisations in Telangana State will be done in consultation with Hony Capts Joseph and MN Reddy.
Gp Capt CRR Sastry inquired if the new Organisations will be admitted into NCESMO immediately or they will all elect the President of AP Unit of NCESMO at appropriate time. Cmde Sudheer Parakala clarified they all will be admitted immediately, but as far as possible there will be only one President of NCESMO unit in a state. Gp Capt CRR Sastry, said that efforts are required to make the transition from interim Committee of NCESMO to Elected National Committee of NCESMO in a smooth manner.

Attendance of Reps of ESM Org at Hon’ble Raksha Mantri (RMs) Meeting: Efforts should be made to mobilise the attendance of Reps ESM Orgs especially those formed by JCO/ORs like ESM Orgs at Cumbum and Tadepalligudem as well as Ex Wel Trust.

Filing Cases Locally: He said that we at HQ TSEWA have 7 cases awaiting filing in which 302 applicants from 21 states have subscribed. We should file them expeditiously by engaging Advocates in Regional Benches if necessary. He said that Ms Manika Roy of Kolkata, Col Satyabhan Singh of Jaipur, Col YR Sharma of Lucknow, Sri Satendra Kumar of Mumbai and Col Kishor Ruperi of Jabalpur have expressed their willingness to take up cases facilitated by TSEWA. Gp Capt Sastry is required to interact with these Counsels initially by making a visit and later from monitoring of their filing till judgment is received. The Jt Secretary said that interacting with such large number of Advocates and monitoring their cases may be a challenge. Monitoring by a local member of TSEWA is more desirable. It was desired that Gp Capt Sastry and Col Ravi Chowdary should work in close coordination.

Visit to Delhi to attend NCESMO: The President said that he and Cmde Sudheer Parakala will visit Delhi for attending the NCESMO meeting on 27thNovember 2018. He proposed that they leave on 25th November 2018 to Jaipur where they will meet Col Satyabhan Singh, advocate in AFT Jaipur and there after reach Delhi on 25th Night. They will meet Brig SKS Rana, President, Legal Div of TSEWA and Brig AK Srivastava on 26th Evening. After the NCESMO Meeting with Hon’ble Raksha Mantri on 27th afternoon, they will return to Secunderabad by Rajdhani Express starting 27th evening and reach Secunderabad by evening of 28th November 2018.
The visit and itinerary were approved by the Committee.
