Payment of Special Pension to Fleet Reservists Supreme Court Order Dated 27 Oct 2016

Dear Veteran Sailors,

Consequent to the Honourable Supreme Court Order dated 27 Oct 2016 passed in Civil Appeal 2147/2011 and 8566/2014 for Grant of Special Pension Under Regulations 95 of Navy Pension Regulations 1964, there have been a lot of queries from affected veteran sailors.

As per the above Supreme Court Order, all Fleet Reservists who were in service prior to 03 Jul 1976 and discharged on or after 03 Jul 1976 were given Special Pension. Earlier, the litigants who were part of the above civil suits only were given Special Pension.

MOD vide their letter dated 26 Sep 2017 have now approved Special Pension to all affected veteran Sailors without the need for any fresh litigation. The conditions for grant of Special Pension are as given in the MOD letter dated 26 Sep 2017 which is appended below.

The implementation of the order of Hon’ble Supreme court regarding special pension to ex. sailors of Indian Navy is faulty and Ministry of Defence, Govt. of India have ignored the essence of the Supre Court Order and are trying to fool around the affected ex. sailors by declaring them having retired on their request, disregarding the fact that engagement and retirement of sailors are affected at the sole discretion of the Navy.

    In my case, I retired after more than 16 years of service in August 1972 and was sanctioned normal service pension AND was also drafted to Fleet Reserve for 10 years with usual conditions of recall for service in case of Emergency or otherwise, Periodical training and not to move out of India at my prime age of 33 years in 172.
    I was allowed to complete Reserve Period of 10 years up to August 1982. My request for Fleet Reservist Pension was refused by NAVPEN stating that “although I am entitled to Fleet Reserve pension, second pension cannot be paid under Regulation of Navy Pension Act 1964 ignoring the fact that Govt of India has since allowed payment of the second pension to Govt./Defence pensioner in supersession of earlier orders in this respect.
    On furnishing aforesaid clarification and furnishing reasons for retaining me Reserve after normal active service as a special case, a fresh reason for disallowing payment of the second pension was given that I have retired before 03-07-1976(disregarding that I was in empanelment on reserve up to 1982) & Hon’ble Supreme Court does not support payment of Special Pension to me wrongly clubbing me with the case of payment of Special pension to Ex. sailors retired after 10 years service. It seems to be an adamant attitude of the
    officials to deprive me from well- earned compensation for 10 years reserve service by hook or by crook.
